Terms of Use

These Terms of Use ("Terms") govern your access to and use of the FlirtSwitch service, including our phone chat line accessible at (888) 901-3030 and our website at https://www.flirtswitch.com (collectively, "the Service"). By using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to use FlirtSwitch. By accessing the Service, you represent and warrant that you are 18 years of age or older. We reserve the right to terminate any account we believe is operated by a minor.

2. Account and Access

You are responsible for all activity conducted through your account or phone session. You agree to provide accurate information when setting up your account. You must not share your account access or allow others to use your purchased talk time.

3. Acceptable Use

By using FlirtSwitch, you agree NOT to:

  • Use the Service for any unlawful purpose
  • Harass, threaten, or engage in abusive behavior toward other callers
  • Impersonate any person or misrepresent your identity
  • Attempt to solicit money, financial information, or goods from other callers
  • Use the Service to facilitate commercial transactions or solicitation
  • Record conversations without the consent of the other party
  • Attempt to identify, locate, or contact callers outside the platform
  • Transmit any content that is defamatory, obscene, or violates third-party rights
  • Interfere with the operation of the Service or its infrastructure

4. Free Trial

New callers receive a complimentary 30-minute free trial upon their first call. The trial is available once per individual (determined by phone number and billing information). Attempts to circumvent the one-trial-per-person limit may result in account suspension. No credit card is required for the free trial.

5. Paid Services and Billing

After your free trial, continued use of the Service requires the purchase of talk time packages. All purchases are final. Refunds may be issued at our sole discretion in cases of documented technical error. By providing payment information, you authorize us to charge the applicable fees.

6. Content Standards

All voice greetings and messages must comply with our platform policies and applicable laws. We reserve the right to remove any content that violates these Terms without prior notice.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

All content, branding, and technology associated with FlirtSwitch are the property of FlirtSwitch or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. FLIRTSWITCH MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLIRTSWITCH, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SERVICE, EVEN IF FLIRTSWITCH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL FLIRTSWITCH’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO FLIRTSWITCH DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

11. Indemnification

You agree to indemnify and hold harmless FlirtSwitch, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or your use of the Service.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions.

14. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
